        Žalba se izjavljuje Državnoj komisiji za kontrolu postupaka javne nabave (Koturaška Cesta 43/4, HR-10000 Zagreb). Žalba se izjavljuje u pisanom obliku. Žalba se dostavlja neposredno, poštom, kao i elektroničkim putem ako su za to ostvareni obostrani uvjeti dostavljanja elektroničkih isprava u skladu s propisom o elektroničkom potpisu. Istodobno s dostavljanjem žalbe Državnoj komisiji, žalitelj je obvezan primjerak žalbe dostaviti i naručitelju na dokaziv način. Žalba se izjavljuje u roku od 10 dana i u skladu s člankom 147. Zakona o javnoj nabavi.
