      2. Lodging of appeals

        Rok za izjavljivanje žalbe:

        a) Žalba se izjavljuje u skladu s čl. 145. Zakona o javnoj nabavi;

        b) Žalba mora sadržavati najmanje podatke navedene u članku 159. Zakona o javnoj nabavi;

        c) U skladu s čl. 146. Zakona o javnoj nabavi, u otvorenom postupku javne nabave velike vrijednosti žalba se izjavljuje u roku 10 dana od dana:

        1. objave poziva na nadmetanje u odnosu na sadržaj poziva na nadmetanje i dokumentacije za nadmetanje te dodatne dokumentacije ako postoji;

        2. objave izmjene dokumentacije za nadmetanje u odnosu na sadržaj izmjene dokumentacije;

        3. otvaranja ponuda u odnosu na propuštanje naručitelja da odgovori na pravodobno dostavljen zahtjev za objašnjenjem ili izmjenom vezanom za dokumentaciju za nadmetanje te na postupak otvaranja ponuda;

        4. primitka odluke o odabiru ili odluke o poništenju u odnosu na postupak pregleda, ocjene i odabira ponuda odnosno razloge poništenja.

        c) Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave sukladno odredbi prethodnog stavka b) nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu.
