            Pravo na žalbu ima svaki gospodarski subjekt koji ima ili je imao pravni interes za dobivanje određenog ugovora o javnoj nabavi, okvirnog sporazuma, dinamičkog sustava nabave ili projektnog natječaja i koji je pretrpio ili bi mogao pretrpjeti štetu od navodnoga kršenja subjektivnih prava.

            Žalba se izjavljuje Državnoj komisiji za kontrolu postupaka javne nabave i to u pisanom obliku. Žalba se dostavlja neposredno, putem ovlaštenog davatelja poštanskih usluga ili elektroničkim sredstvima komunikacije putem međusobno povezanih informacijskih sustava Državne komisije i EOJN-a RH. Žalbeni postupak vodi se prema odredbama ZJN-a 2016 i Zakona o općem upravnom postupku. Žalbeni postupak vodi se na hrvatskom jeziku i uz uporabu latiničnog pisma.

            Žalba se izjavljuje u roku 10 (deset) kalendarskih dana, i to od dana:

            1. objave poziva na nadmetanje, u odnosu na sadržaj poziva ili dokumentacije o nabavi,

            2. objave obavijesti o ispravku, u odnosu na sadržaj ispravka,

            3. objave izmjene dokumentacije o nabavi, u odnosu na sadržaj izmjene dokumentacije,

            4. otvaranja ponuda u odnosu na propuštanje Naručitelja da valjano odgovori na pravodobno dostavljen zahtjev dodatne informacije, objašnjenja ili izmjene dokumentacije o nabavi te na postupak otvaranja ponuda,

            5. primitka odluke o odabiru ili poništenju, u odnosu na postupak pregleda, ocjene i odabira ponuda, ili razloge poništenja.

            Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave sukladno prethodno navedenim rokovima, nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu.
